1. Acceptance of Terms

Welcome to ShotSensay. By downloading, accessing, or using our mobile or web application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service. These Terms form a binding legal agreement between you and Alpine Stream, LLC ("we," "us," or "our").

2. Description of Service

ShotSensay provides golf tracking, course AI mapping, elevation adjustments, and related tools (the "Service"). Our application is designed to help golfers enjoy their rounds more with smarter data. However, as any golfer knows, the wind lies, bounces are unpredictable, and actual reality may occasionally differ from our 3D terrain projections. Play the smart shot, but you are solely responsible for your game and actions on the course.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction (typically 18), you must have permission from your parent or guardian to use the App. Making purchases or subscribing to premium plans requires you to be at least 18 years of age or possess legal parental or guardian consent.

4. Accounts and Registration

To use certain features, you must register for an account using your phone number or email address. You are responsible for safeguarding your login credentials and for all activities that occur under your account.

5. Subscriptions and Payments

ShotSensay offers multiple tiers ranging from Free to Premium. If you choose a paid subscription, billing is handled securely via Stripe. By providing payment information, you authorize us to charge your chosen payment method. Subscriptions automatically renew unless canceled before the end of the current billing period. All sales are final and no refunds will be issued for partial terms unless required by law.

6. User Conduct and Content

You agree not to misuse the Service or help anyone else do so. This includes but is not limited to: scraping data, attempting to bypass security features, or using the App for illegal purposes. By submitting any data, game plans, or feedback strings ("User Content") to the App, you grant Alpine Stream, LLC a worldwide, royalty-free, non-exclusive license to use, reproduce, and modify that content to operate and improve the Service.

7. Assumption of Risk

Golf is a physical sport with inherent risks. By using ShotSensay out on the course, you explicitly acknowledge and assume all risks associated with playing golf. Alpine Stream, LLC is not responsible for any physical injury, death, or property damage (such as broken windows or damaged golf carts) that may occur while you are using the App. Always remain aware of your surroundings.

8. Disclaimer of Warranties & AI

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not guarantee the accuracy, completeness, or reliability of any course data, weather information, or AI recommendations.

Generative AI Disclaimer: The App uses artificial intelligence to generate caddy recommendations. AI can hallucinate, be factually incorrect, or fail to account for real-world nuances. You should never use AI recommendations as a substitute for your own judgment.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPINE STREAM, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR CONTENT.

10. Indemnification

You agree to defend, indemnify, and hold harmless Alpine Stream, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, in our sole discretion, for any reason whatsoever, including without limitation a breach of these Terms.

12. Dispute Resolution & Class Action Waiver

These Terms shall be governed by the laws of the State of Illinois. You agree that any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration in Illinois, rather than in court. YOU EXPLICITLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

13. App Store & Google Play Stipulations

If you downloaded the App from the Apple App Store or Google Play, you acknowledge that these Terms are between you and Alpine Stream, LLC only, not with Apple or Google. Apple and Google are not responsible for the App, any maintenance, support, or claims related to the App. Apple and Google are third-party beneficiaries to these Terms and have the right to enforce them against you.

14. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. These Terms constitute the entire agreement between you and Alpine Stream, LLC regarding the Service.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
